How to Register a Trademark in India

A trademark is a unique identity that distinguishes goods or services of one business from another. In India, trademarks are governed by the Trade Marks Act, 1999 and registered under the Controller General of Patents, Designs and Trade Marks (CGPDTM), Ministry of Commerce & Industry.

  • Types of trademarks:

Trademark Registration Process in India

Trademark Search

  • Purpose: Ensures the proposed mark is unique and not identical/similar to existing marks in the chosen class.
  • How To Search: Use the IP India Public Search tool online. Search by wordmark, phrase, device, or class.
  • Importance: Avoids legal hassles and ensures a successful application.

Filing Application

  • Online Filing: Via IP India’s e-filing portal.
  • Physical Filing: At the appropriate Trademark Registrar Office.
  • Contents: Applicant’s details, mark, description, class, first use date, declaration, and supporting documents.
  • Fees: Government fee varies for individuals, SMEs, and others (₹4,500-₹9,000+ per class).

Examination by Registrar

  • Process: Registrar checks uniqueness, compliance with the law, and raises objections if needed.
  • Response: Applicant replies to official objections within the allotted time.
  • Show Cause Hearing: Sometimes needed for clarifying objections.

Publication in Trademark Journal

  • Purpose: To give third parties opportunity to oppose registration if they believe the mark infringes their rights.
  • Duration: 4 months for opposition.

Trademark Registration & Certificate

  • No Opposition: If no valid opposition, the trademark is registered, and a certificate is issued.
  • Validity: 10 years, renewable indefinitely in blocks of 10 years.

Classes of Trademark

India follows the Nice Classification (NCL) system:

  • Class 1–34 → Goods
  • Class 35–45 → Services
  • Each class represents a category of goods/services. For example:
    • Class 25: Clothing, footwear, headgear
    • Class 30: Coffee, tea, rice
    • Class 35: Advertising, business management (services)

Why Is Choosing the Right Class Important?

  • Registration in incorrect class means lack of legal protection for your actual products/services.
  • Each class requires a separate application and fee.
